County Garden Management: Returns Policy

 


Goods


The description of the goods is as set out in the website, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in the size and colour of the goods supplied.

In the case of any goods made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.

All goods which appear on the website are subject to availability.

We can make changes to the goods which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.



Order Acceptance, payment and contract


We will notify you by e-mail as soon as possible to confirm receipt of your order. Orders placed by you are an offer to purchase and will be accepted by us, subject to stock availability. If something is not in stock, we will either let you know at the time of ordering or as soon after the order has been placed as possible. The contract for the sale of the goods will be formed when we send e-mail confirmation to you.  Acceptance will be complete at the time that we send this email to you. It’s worth remembering that any products on the same order which we have not confirmed in the confirmation email do not form part of that contract. It is your responsibility to ensure the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the order placed by you.

We reserve the right to change at any time any of the details of the products on the site, including prices, colours and sizes. We reserve the right to change these terms and conditions and we advise that you read through them each time that you use the site.


Prices and charges include VAT at the rate applicable at the time of the order.


To securely receive payments over the internet, we use a third party payment provider, please see our security notice and privacy policy for further information on how we use and store your personal information. This website, its content and any contracts arisen out of it are governed by and in accordance with English law. All contracts are conducted in English and by entering into a contract both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.


We accept most major credit and debit cards. For security reasons we reserve the right to only deliver to the cardholder’s address.

Delivery of online orders


In our email confirmation we will give dispatch details.
Please take care when entering your address details as we cannot accept liability for non-delivery of items as a result of incorrect information entered by you. In the event that you are not available to receive the goods at the point when they were delivered, you will be responsible for making arrangements to receive the goods; this may include a re-delivery charge.
We will try to meet any date stated for delivery, but the dates are not guaranteed. Occasionally it may become necessary for us to cancel your order before delivery. We will let you know as soon as we can that this has happened and you will not be charged, or if you have been charged, we will refund the full amount to you.
When your order arrives you must check for damages and shortages. Claims for damages and shortages have to be made within 48 hours of receipt of your delivery. Claims for damages or shortages made after this time may be refused.


Cancelation of Order


Under the United Kingdom’s Distance Selling Regulations you have the right to cancel your order. To do so you must inform us in writing within 14 days from the day after receipt of your order to our Head Office, either by post or email. Returning any item within 14 days will also be taken as notice of cancellation of your order (or part of your order). These Cancellation Rights, however, do not apply to a contract for the following goods:


   •    goods that are made to your specifications or are clearly personalised
   •    goods which are liable to deteriorate or expire rapidly.

Also, the Cancellation Rights for a Contract cease to be available in the following circumstances:

   •    In the case of any sales contract, if the goods become mixed inseparably (according to their nature) with other items after delivery.

 


Please quote your order number on all correspondence.

Goods are provided to you on approval and legal title to the goods will not pass to you until the 14 days post-delivery period has expired. On receipt of the goods, County Garden Management will give you a full refund of the amount paid or an exchange/credit as required. If you return goods on which you have received a discount/offer, that discount/offer will no longer apply if you fall below the discount/offer threshold. The contract in respect of sale of goods between County Garden Management and you requires that you return the goods to Bardfield Garden Centre on cancellation. This does not affect your statutory rights.

 


Damaged or Defective Goods


If you receive an item that is damaged or defective, we will either replace the goods (or the faulty part of the item) free of charge or, at our sole discretion, refund to you the price of the goods (or a proportionate part of the price). Simply return the goods to us unused. We will make the refund using the same means of payment as you used for the initial transaction you will not incur any fees as a result of the reimbursement.
 


Risk and Title


Risk of damage to or loss of any goods will pass to you when the goods are delivered to you.
 


Returns


Simply return the unwanted item within 28 days of the invoice date, unused, unopened and with the packaging intact and we will assume your order is cancelled and we will refund the full amount to you or give you an exchange (as required). We will make the refund using the same means of payment as you used for the initial transaction you will not incur any fees as a result of the reimbursement.

If you would rather have replacement goods, County Garden Management can arrange for delivery to you; this constitutes a separate contract between you and County Garden Management and the delivery charges will apply in the usual way (except where we are replacing damaged or defective goods).


Please tell us why you are returning the product – this ensures that we can improve our service and products in the future. On returned goods on which you have received a discount/offer, that discount/offer will no longer apply if you fall below the discount/offer threshold.


We endeavour to process return refunds/exchanges as soon as possible, but please allow 21 working days.
